SHOPPING CARD TERMS AND CONDITIONS
1. Introduction
This Cardholder Agreement governs the use of Your Wertheim Village Prepaid MasterCard® Shopping Card. The Wertheim Village Prepaid MasterCard® Shopping Card is not a Credit Card, Debit Card, or Cheque Guarantee Card. The Wertheim Village Prepaid MasterCard® Shopping Card is issued by Wirecard Card Solutions Ltd, Grainger Chambers, 3-5 Hood Street, Newcastle upon Tyne, NE1 6JQ, United Kingdom, pursuant to licence by MasterCard International Inc. Wirecard Card Solutions Ltd is authorised by the Financial Conduct Authority to conduct electronic money service activities under the Electronic Money Regulations 2011 (Ref: 900051) Your Wertheim Village Prepaid MasterCard® Shopping Card is the property of Wirecard Card Solutions Ltd and is not transferable to anyone else. MasterCard is a registered trademark of MasterCard International Incorporated.
The reverse of the Wertheim Village Prepaid MasterCard® Shopping Card must be signed by the Cardholder before it is used for a Transaction. By signing or by using the Wertheim Village Prepaid MasterCard® Shopping Card to make a Transaction, You accept and agree to abide by all the terms and conditions of this Cardholder Agreement. The Wertheim Village Prepaid MasterCard® Shopping Card will not be valid unless signed. The Wertheim Village Prepaid MasterCard® Shopping Card may not be exchanged for cash or credit.
The Purchaser must instruct the Cardholder on how to use the Wertheim Village Prepaid MasterCard® Shopping Card and also inform them of the terms of this Cardholder Agreement.
The Wertheim Village Prepaid MasterCard® Shopping Card is a prepaid Shopping Card that can be used for retail shopping in Wertheim Village and in any other Village and where You see the MasterCard acceptance mark, subject to the terms of this Cardholder Agreement. The Wertheim Village Prepaid MasterCard® Shopping Card cannot be used at ATMs or online for telephone orders or mail order transactions or at Unattended Payment Terminals. Interest, dividends or other earnings or returns will not be paid for the Available Funds loaded onto the Wertheim Village Prepaid MasterCard® Shopping Card. There is no credit card, credit line, overdraft protection, or deposit account associated with the Wertheim Village Prepaid MasterCard® Shopping Card. No PIN will be issued with the Wertheim Village Prepaid MasterCard® Shopping Card. The Available Funds are not stored on the Wertheim Village Prepaid MasterCard® Shopping Card itself; instead, they are stored on a computer system. A minimum value of €5 and a maximum value of €1,500 may be loaded onto the Wertheim Village Prepaid MasterCard® Shopping Card purchased at Wertheim Village. A maximum of €300 may be loaded onto any Wertheim Village Prepaid MasterCard® Shopping Card purchased online. Fees apply to the purchase and use of the Wertheim Village Prepaid MasterCard® Shopping Card as outlined in the Fees section of this Cardholder Agreement.
2. Definitions
ATM
means an automated teller machine.
Available Funds
means the prepaid monetary value loaded on the Wertheim Village Prepaid MasterCard® Shopping Card by the Purchaser, less any transactions, fees and charges that may occur from time to time.
BPS Limited
means Branded Payment Solutions Ltd of Grattan House, City Junction Business Park, Malahide Road, Dublin 17, Ireland and its successors and assigns, the administrator of the Card Programme on behalf of the Issuer and supplier of technology systems to operate the Wertheim Village Prepaid MasterCard® Shopping Card.
Cardholder
means (i) the individual in whose name a Wertheim Village Prepaid MasterCard® Shopping Card has been issued; and (ii) any individual who possesses and uses a Wertheim Village Prepaid MasterCard® Shopping Card and whose signature appears on the reverse of the Wertheim Village Prepaid MasterCard® Shopping Card.
Cardholder Declaration Form
means a declaration form which is sent to You when You have reported Your Wertheim Village Prepaid MasterCard® Shopping Card lost or stolen or have noticed fraudulent transactions on the Wertheim Village Prepaid MasterCard® Shopping Card transaction history.
Card Programme
means the Wertheim Village Prepaid MasterCard® Shopping Card related services marketed and made available to You, subject to the terms and conditions of this Cardholder Agreement.
Cheque Guarantee Card
means a card issued by a bank, building society or other financial institution for the purposes of guaranteeing settlement of cheques to third parties or supporting the encashment of cheques at financial institutions up to a specified value.
Date of Activation
means the date on which the Purchaser receives the Wertheim Village Prepaid MasterCard® Shopping Card.
Debit Card
means any card which enables the holder to purchase goods and services by authorising an electronic debit from a designated account, in Germany amongst others known as EC-Card.
Expiry Date
means a date thirty six (36) months from Date of Activation of the Wertheim Village Prepaid MasterCard® Shopping Card.
Issuer
means Wirecard Card Solutions Ltd, the issuer and owner of the Wertheim Village Prepaid MasterCard® Shopping Card.
MasterCard
means MasterCard International Incorporated.
Payment Card
means any card which is linked to a designated account and which enables the holder to purchase goods and services on credit.
PIN
means Personal Identification Number.
POS Equipment
means a terminal or other point-of-sale device of a Retail Merchant that is used to process a Transaction.
Purchaser
means the person who purchased the Wertheim Village Prepaid MasterCard® Shopping Card.
Retail Merchant
means a retailer which sells goods and services at Wertheim Village or at any other Village.
Shortfall
means any time that a Wertheim Village Prepaid MasterCard® Shopping Card has insufficient Available Funds to complete a Transaction.
Transaction
means any purchase made by a Cardholder for goods and/or services at a Retail Merchant using the Wertheim Village Prepaid MasterCard® Shopping Card, which is either authorised or denied by Us.
Unattended Payment Terminal
means a self-service device at which the Cardholder can receive payment services, respectively at which the Cardholder can purchase goods. Wertheim Village Prepaid MasterCard® Shopping Card
Unclaimed Funds
means the monetary value of funds that are loaded onto the Wertheim Village Prepaid MasterCard® Shopping Card and which have not been spent before the Expiry Date.
Us, We and Our
means either the Issuer or BPS Limited or both.
You and Your
means the Cardholder.
Value Retail
means Value Retail Management Germany GmbH.
Village
means La Vallée Village (Paris), Las Rozas Village (Madrid), La Roca Village (Barcelona), Fidenza Village (Milan), Maasmechelen Village (Brussels), Ingolstadt Village (Frankfurt), Wertheim Village (Munich), Kildare Village (Dublin) and any other retail outlet village to which Value Retail Management Ltd. or its subsidiaries provides services.
Website
means www.WertheimVillage.com
Wertheim Village
means the retail outlet village at Almosenberg, 97877 Wertheim, Germany.
Wertheim Village Prepaid MasterCard® Shopping Card
means the Wertheim Village Prepaid MasterCard® Shopping Card which is sold at Wertheim Village or online.
Wertheim Village Prepaid MasterCard® Shopping Card Number
means the number printed on the front of the Wertheim Village Prepaid MasterCard® Shopping Card.
3. Use of the Wertheim Village Prepaid MasterCard® Shopping Card
Once the Available Funds of the Wertheim Village Prepaid MasterCard® Shopping Card are fully used, the Wertheim Village Prepaid MasterCard® Shopping Card will no longer be usable for any Transactions. The money paid by the Purchaser will be deposited on an account with Us. You cannot link the Wertheim Village Prepaid MasterCard® Shopping Card to any bank, deposit or credit account which You may have at any financial institution. The Wertheim Village Prepaid MasterCard® Shopping Card cannot be reloaded with additional Available Funds and should be disposed of when all Available Funds have been used. Since the Wertheim Village Prepaid MasterCard® Shopping Card's Available Funds have been prepaid, You should treat it the same as cash.
When the Wertheim Village Prepaid MasterCard® Shopping Card's Available Funds have been depleted, destroy the Wertheim Village Prepaid MasterCard® Shopping Card by cutting it in half through both the magnetic stripe and the Wertheim Village Prepaid MasterCard® Shopping Card number. Each Wertheim Village Prepaid MasterCard® Shopping Card is owned, issued and remains the property of the Issuer. You
must surrender the Wertheim Village Prepaid MasterCard® Shopping Card to Us, or Value Retail upon their request.
4. Expiration of Your Wertheim Village Prepaid MasterCard® Shopping Card
The value on Your Wertheim Village Prepaid MasterCard® Shopping Card expires 36 months after the Date of Activation. Section 195 of the German Civil Code applies. After of the just mentioned period, Your Wertheim Village Prepaid MasterCard® Shopping Card cannot be used for the purchase of goods and/or services. However, You are entitled to a refund of the then available value on Your Wertheim Village Prepaid MasterCard® Shopping Card minus fees within a period of further 36 months as of the date of expiration of Your Wertheim Village Prepaid MasterCard® Shopping Card. For Your refund request, please contact Customer Service, BPS Ltd, Grattan House, City Junction Business Park, Malahide Road, Dublin 17, Ireland or customersupport@bpscards.com.
5. Using the Wertheim Village Prepaid MasterCard® Shopping Card
You may use the Wertheim Village Prepaid MasterCard® Shopping Card to purchase goods and/or services at any Retail Merchant which accepts Payment Cards that show the MasterCard acceptance mark. By presenting this Wertheim Village Prepaid MasterCard® Shopping Card as form of payment for goods and/or services, You are authorising a deduction in the Available Funds of the Wertheim Village Prepaid MasterCard® Shopping Card in order to cover the amount of the Transaction. You must not use the Wertheim Village Prepaid MasterCard® Shopping Card to spend more than the Available Funds at any time. If You attempt to spend more than the Available Funds Your Transaction may be declined. In the event that You spend more than the Available Funds at any time, any such amount shall be repayable by You immediately on demand. Subject to the applicable law, We may recover the costs of collecting any such amount from You. All Transactions will be subject to the terms of this Cardholder Agreement. Nothing in this Cardholder Agreement shall require Us to authorise any Transaction.
The Available Funds on the Wertheim Village Prepaid MasterCard® Shopping Card are in Euro. If We make a deduction from Your Available Funds for a non-Euro Transaction, We will convert the sum into Euro at the exchange rate set by MasterCard on the day in which the Transaction is processed. Further instructions on how to use Your Wertheim Village Prepaid MasterCard® Shopping Card are found on the Website. You will need to follow these instructions when using Your Wertheim Village Prepaid MasterCard® Shopping Card. We will deduct the value of Your Transactions from the balance on Your Wertheim Village Prepaid MasterCard® Shopping Card as soon as they are made. We will also deduct any applicable fees as soon as they become payable by You. (See Our Fees section below for details of Our Fees).
The Wertheim Village Prepaid MasterCard® Shopping Card belongs to Us. We may ask You to stop using Your Wertheim Village Prepaid MasterCard® Shopping Card and return it to Us or destroy it. We may at anytime suspend, restrict or cancel Your Wertheim Village Prepaid MasterCard® Shopping Card or refuse to issue or replace a Wertheim Village Prepaid MasterCard® Shopping Card for reasons relating to the following:
- We are concerned about security of Your account or Wertheim Village Prepaid MasterCard® Shopping Card We have issued to You;
We suspect Your account is being used in an unauthorised or fraudulent manner; or
We need you to comply with the law.
We will tell You before We do this unless We are not able or permitted to do so in which case We will tell You afterwards.
Like other payment cards, We cannot guarantee a Retail Merchant or any other merchant which accepts MasterCard will accept Your Wertheim Village Prepaid MasterCard® Shopping Card. We may also refuse to pay a Transaction if:
- We are concerned about security of Your account or We suspect Your account is being used in an unauthorised or fraudulent manner;
- sufficient funds are not loaded on Your Wertheim Village Prepaid MasterCard® Shopping Card at the time of a Transaction to cover the amount of the Transaction and any applicable Fees;
- there is an outstanding Shortfall on Your Wertheim Village Prepaid MasterCard® Shopping Card in accordance with Section 6;
- We have reasonable grounds to believe that You are acting in breach of this Cardholder Agreement;
- We believe that a Transaction is potentially suspicious or illegal (for example, if We believe that a Transaction is being made fraudulently); or
- because of errors, failures (whether mechanical or otherwise) or refusals by Retail Merchants, payment processors or payment schemes processing Transactions.
If We refuse to authorise a Transaction We will tell You at the point of the Transaction either orally or in writing depending on the nature of the Transaction being made unless it would be unlawful for Us to do so. If We are able, We will also notify You of the reasons for the refusal. You may correct any information We hold and which may have caused Us to refuse a Transaction by contacting Us at customersupport@bpscards.com.
6. Authorising Transactions
A Wertheim Village Prepaid MasterCard® Shopping Card Transaction will be regarded as authorised by You where You:
- authorise the Transaction at the point of sale by following the instructions provided by the Retail Merchant to authorise the Transaction, which may include:
a) signing a sales voucher;
b) providing the Wertheim Village Prepaid MasterCard® Shopping Card details and or providing any other details as requested;
c) swiping the Wertheim Village Prepaid MasterCard® Shopping Card through POS Equipment;
Authorisation for a Transaction may not be withdrawn (or revoked) by You after the time it is received. However, the following Transactions may be withdrawn if You give Us notice (providing a copy of the notice to Us):
- any Transaction which is agreed to take place on a date later than the date it was authorised as long as notice was provided no later than the close of business on the business day before it was due to take place;
We may charge You a fee if a Transaction is withdrawn (or revoked) by You under this condition.
Funds to cover the authorised Transactions received by Us will be paid over to the Retail Merchant within 3 days following the receipt by Us of the instruction to make payment. A Transaction (the payment order) will be received as follows:
- for purchases, at the time We receive the Transaction instruction from the Retail Merchant;
- for other Transactions which are communicated directly to Us, at the time You ask Us to complete the Transaction.
- If, in relation to a) purchases, We receive the transaction instruction from the Retail Merchant; or b) other Transactions communicated directly to Us, You ask Us to complete the Transaction;
After 5pm GMT the Transaction instruction or request will be deemed to have been received by Us on the following business day. Authorisation will be requested for all Transactions at the time of each Transaction. In the unlikely event, for any reason whatsoever, a Transaction is completed when there is a Shortfall, the Shortfall shall be reimbursed by You unless it is due to an error on the part of the Retail Merchant where the Wertheim Village Prepaid MasterCard® Shopping Card was presented. In this circumstance We may seek the Shortfall from the Retail Merchant.
You agree that once We make this Shortfall known to You We may charge You for the Shortfall amount. We may charge the amount of the Shortfall to any other Wertheim Village Prepaid MasterCard® Shopping Cards that You hold with Us, to any other payment method which You may designate at that time, or on any additional Wertheim Village Prepaid MasterCard® Shopping Card ordered by You. Until We are reimbursed the Shortfall amount, We may suspend Your Wertheim Village Prepaid MasterCard® Shopping Card and any additional Wertheim Village Prepaid MasterCard® Shopping Card connected to You. In addition, We reserve the right to charge You an Administration Fee for each Transaction that You make using Your Wertheim Village Prepaid MasterCard® Shopping Card that results in a Shortfall or increases the Shortfall amount on Your Wertheim Village Prepaid MasterCard® Shopping Card.
7. Pre-Authorised & Recurring Payment
You agree not to make pre-authorised or recurring regular payments through the use of the Wertheim Village Prepaid MasterCard® Shopping Card.
8. Balance Enquiry
Balance enquiries will be available from the point of Wertheim Village Prepaid MasterCard® Shopping Card activation at Wertheim Village and are also available online at the Website and by calling the number on the back of the Wertheim Village Prepaid MasterCard® Shopping Card.
9. Lost & Stolen Cards
The Wertheim Village Prepaid MasterCard® Shopping Card must be treated like cash. You agree to use Your best efforts to protect the Wertheim Village Prepaid MasterCard® Shopping Card against loss, theft or unauthorised use. A replacement for a Wertheim Village Prepaid MasterCard® Shopping Card may only be issued, if the Wertheim Village Prepaid MasterCard® Shopping Card has been duly reported to Us as lost or stolen by contacting the Customer Helpdesk. The Customer Helpdesk will cancel the lost or stolen Wertheim Village Prepaid MasterCard® Shopping Card and send You a Cardholder Declaration Form which You must fill out and send back to Customer Service, BPS Ltd, Grattan House, City Junction Business Park, Malahide Road, Dublin 17, Ireland. Within thirty (30) days of receiving Your Cardholder Declaration Form, We will issue a replacement Wertheim Village Prepaid MasterCard® Shopping Card to the Purchaser for the Available Funds still remaining on the Wertheim Village Prepaid MasterCard® Shopping Card at the time that You notified Us, less a Lost & Stolen processing fee of €7.50. A replacement Wertheim Village Prepaid MasterCard® Shopping Card will not be issued where the balance remaining on the Wertheim Village Prepaid MasterCard® Shopping Card is less than the Lost & Stolen Fee or where Your Cardholder Declaration Form is incomplete. You must tell Us without undue delay by calling Us on Our 24 hour lost and stolen card helpline on 0800 5250275 if You know or suspect that a Wertheim Village Prepaid MasterCard® Shopping Card is lost or stolen or if You think a Transaction has been incorrectly executed. If You ask Us to do so, We will investigate any disputed Transaction or misuse of Your Wertheim Village Prepaid MasterCard® Shopping Card and We may need more information and assistance from You.
Provided You notify Us without undue delay and You have not acted fraudulently or with gross negligence We will refund the amount of any Transactions which Our investigations show are not authorised by You. However, if the investigations show that any disputed Transaction was authorised by You, or You have acted fraudulently or with gross negligence (for example by failing to keep Your Wertheim Village Prepaid MasterCard® Shopping Card secure) We will not refund the Transaction amount and will charge You a Refund Fee (see Fees section below).
10. Our Liability
Neither You, nor any Retail Merchant is an agent or partner of the Issuer, BPS Ltd, Value Retail or their affiliates.
The Issuer, BPS Ltd or Value Retail shall not have any liability or obligation as to Your use of the Wertheim Village Prepaid MasterCard® Shopping Card or participation in the Card Programme, and You hereby release Us and Value Retail from any and all claims You may have in connection with any action or omission of Us, Value Retail or a Retail Merchant and their respective affiliates, agents or vendors, regarding Your use of the Wertheim Village Prepaid MasterCard® Shopping Card. MasterCard, BPS Ltd, the Issuer and Value Retail are not liable:
- for any failed Transactions if You do not have sufficient Available Funds on Your Wertheim Village Prepaid MasterCard® Shopping Card to pay for a Transaction;
- if the Retail Merchant’s MasterCard POS Equipment is not working properly;
- if circumstances beyond Our control prevent the Transaction; or
- a Retail Merchant authorises an amount greater than the price of the goods and/or services.
We will not be liable for any loss arising from:
- any cause which results from abnormal or unforeseen circumstances beyond Our control, the consequences of which would have been unavoidable despite all Our efforts to the contrary;
- a Retail Merchant refusing to accept Your Wertheim Village Prepaid MasterCard® Shopping Card;
- Our compliance with legal and regulatory requirements; or
- loss or corruption of data unless caused by Our wilful default.
We are also not liable for:
- business interruption, loss of revenue, goodwill, opportunity or anticipated savings;
- any indirect or consequential loss which could not reasonably have been foreseen by Us.
We reserve the right to charge You for any reasonable costs that We incur in taking action to stop You using this Wertheim Village Prepaid MasterCard® Shopping Card and to recover any monies owed as a result of Your activities.
Where a transaction is incorrectly executed, We are liable:
- for transactions initiated by Us unless the person to whom funds were sent is proved to have made the error;
- for purchases, if it can be proved that We received the payment order.
11. Cancellation
As the Cardholder, You have a legal right to cancel Your Wertheim Village Prepaid MasterCard® Shopping Card up to fourteen (14) days after the Date of Activation of the Wertheim Village Prepaid MasterCard® Shopping Card without being charged the Refund Fee provided You have not used Your Wertheim Village Prepaid MasterCard® Shopping Card during this fourteen (14) day period – this is known as the “Cooling-Off Period”. We will immediately block it so it cannot be used.
In order to process Your Cardholder cancellation, You must request the cancellation in person at Wertheim Village, You will need to provide Us with Your physical Wertheim Village Prepaid MasterCard® Shopping Card, Your purchase receipt and Your Wertheim Village Prepaid MasterCard® Shopping Card receipt and identification if applicable. If Your Wertheim Village Prepaid MasterCard® Shopping Card was purchased online You must present the activation letter sent to You.
We may also cancel Your Cardholder agreement for any reason by giving You at least 2 month's notice. If We cancel Your Wertheim Village Prepaid MasterCard® Shopping Card You must tell Us what You want Us to do with any unused funds within 3 months of the date We tell You Your Wertheim Village Prepaid MasterCard® Shopping Card is cancelled.
If Your Wertheim Village Prepaid MasterCard® Shopping Card is cancelled, We will immediately block Your Wertheim Village Prepaid MasterCard® Shopping Card so it cannot be used.
You will not be entitled to a refund of money You have already spent on Transactions authorised, or pending or for any fees charged for use of the Wertheim Village Prepaid MasterCard® Shopping Card before the Wertheim Village Prepaid MasterCard® Shopping Card is cancelled or expires.
If You cancel Your Wertheim Village Prepaid MasterCard® Shopping Card, once all Transactions and Fees have been deducted, We will arrange for any Available Funds to be refunded to You, see "Your Right to a Refund" section below for further information.
12. Keeping Your Wertheim Village Prepaid MasterCard® Shopping Card Secure
You should treat Your Wertheim Village Prepaid MasterCard® Shopping Card like cash. If it is lost or stolen, You may lose some or all of Your money on Your Wertheim Village Prepaid MasterCard® Shopping Card, in the same way as if You lost cash in Your wallet or purse. As a result, You must keep Your Wertheim Village Prepaid MasterCard® Shopping Card safe and not let anyone else use it.

We recommend that You check the balance and Transaction history on Your Wertheim Village Prepaid MasterCard® Shopping Card regularly online at the Website. Your statement will show:
- information relating to each Wertheim Village Prepaid MasterCard® Shopping Card Transaction which will enable it to be identified;
- the amount of the Wertheim Village Prepaid MasterCard® Shopping Card Transaction shown in the currency in which the Transaction was paid or debited to the account;
- the amount of charges for the Transaction
- any exchange rate used by Us to effect any currency conversion and the amount payable after the currency conversion has been made; and
- the date the Transaction is authorised or posted on to the account.
A charge will be made for supplying additional or duplicate copies of statements on paper of €7.50.
13. Your Right to a Refund
13.1 The funds on Your Wertheim Village Prepaid MasterCard® Shopping Card
You may request a refund of the funds on Your Wertheim Village Prepaid MasterCard® Shopping Card provided You have more than €7.50 loaded on Your Wertheim Village Prepaid MasterCard® Shopping Card. To do so, send Us an e-mail using the details on the Customer Support page on the Website requesting a refund and confirming that You have destroyed Your Wertheim Village Prepaid MasterCard® Shopping Card by cutting it up. When We process Your Refund, We will charge a Refund Fee (see Fees section below).
We will send a cheque to Your last notified address or arrange an electronic transfer to a bank account nominated by You. However, to enable Us to comply with Our legal obligations, We may ask You to provide Us with certain information before We can process Your refund request.
13.2 Refunding Transactions
You may be entitled to claim a refund in relation to Transactions where: a. the Transaction was not authorised under this Cardholder Agreement; b. We are responsible for a Transaction which was incorrectly executed; c. a pre-authorised Transaction did not specify the exact amount at the time of its authorisation and the amount charged by a Retail Merchant is more than You could reasonably have expected taking into account normal spending patterns on the Wertheim Village Prepaid MasterCard® Shopping Card or the circumstances of the Transaction. A claim for a refund in these circumstances will not be accepted if the amount of the Transaction was made available to You at least 4 weeks before the Transaction date or it is made more than 8 weeks after being debited to Your account.
14. Retail Acceptance
Neither MasterCard, Value Retail, BPS Ltd nor the Issuer are responsible if a Retail Merchant fails to honour Your Wertheim Village Prepaid MasterCard® Shopping Card, for defects in or non-delivery of any goods or services You may purchase with the Wertheim Village Prepaid MasterCard® Shopping Card or for the failure of any POS Equipment to correctly complete a Transaction. If there is a problem or dispute with the purchase of goods and/or services, You must address it directly with the Retail Merchant involved. Refunds and returns are subject to the Retail Merchant’s policies or applicable laws.
15. Address of Wertheim Village Prepaid MasterCard® Shopping Card Purchaser
The address associated with Your Wertheim Village Prepaid MasterCard® Shopping Card will be the address, provided to Us by the Purchaser. However, if the Cardholder is other than the Purchaser, We will respond to any written enquires using the name and address stated by the person making the enquiry or request.
16. Personal Information
We collect information provided at the time of purchase of the Wertheim Village Prepaid MasterCard® Shopping Card together with information We learn about a Cardholder from Wertheim Village Prepaid MasterCard® Shopping Card Transactions and in connection with a Cardholder's participation in any Wertheim Village Prepaid MasterCard® Shopping Card promotions. We will process and record this information and sometimes use third party decision making systems to verify this information. In order to process, use, record and release the information We collect, We may pass this information outside Ireland to other countries within the European Union.
We use the information that We collect to process Wertheim Village Prepaid MasterCard® Shopping Card Transactions, to help protect against fraud and to otherwise enable Us to provide and personalise the Card Programme. This includes use of information for marketing purposes and to conduct research and analysis. We may also from time to time, in providing and personalising the Card Programme, need to disclose the information that We collect for the same purposes to the companies that work with Us or provide any part of the Card Programme to a Cardholder. For example, We will release certain information to Value Retail so that they may contact You by post, e-mail, SMS and other appropriate means with information about products, services, offers and events that they consider may be of interest to You. For more information about Value Retail and its associated companies and how they may use the information You submit when purchasing a Wertheim Village Prepaid MasterCard® Shopping Card please see Value Retail Management Germany’s Privacy Policy (www.wertheimvillage.com). We will keep the information that We collect about Cardholders for only as long as We need to or are otherwise authorised by law.
By using the Wertheim Village Prepaid MasterCard® Shopping Card, You agree that We may use and disclose information that We collect about You in the manner and for the purposes described. If You would like a copy of any personal information that We hold about You, please write to Us at BPS Ltd, Grattan House, City Junction Business Park, Malahide Road, Dublin 17, Ireland. A fee may be payable.
17. Fees
17.1 Lost & Stolen Fee: €7.50
This fee is only charged should You lose or have Your Wertheim Village Prepaid MasterCard® Shopping Card stolen, notify Us and elect to transfer Your remaining Wertheim Village Prepaid MasterCard® Shopping Card balance to a new Wertheim Village Prepaid MasterCard® Shopping Card. This fee covers the costs incurred in re-issuing a Wertheim Village Prepaid MasterCard® Shopping Card.
17.2 Refund Fee: €7.50
This fee is charged should You choose to get a refund of Your Available Funds before expiration of the Wertheim Village Prepaid MasterCard® Shopping Card. This fee is to cover the costs incurred in manually closing the account and sending a cheque to the Purchaser. This fee is not charged should You request a refund within fourteen (14) days of the Date of Activation and if You have not made a Transaction with the Wertheim Village Prepaid MasterCard® Shopping Card. The Refund Fee is the lower of €7.50 or the balance left on the Wertheim Village Prepaid MasterCard® Shopping Card.
17.3 Issue Fee: €1.00
An Issue Fee is charged for each Wertheim Village Prepaid MasterCard® Shopping Card issued in Wertheim Village or purchased online. This fee is paid in addition to the Available Funds deposited on the Wertheim Village Prepaid MasterCard® Shopping Card. If a Wertheim Village Prepaid MasterCard® Shopping Card is purchased online it is subject to an additional ecommerce transaction fee of € 2.50.
17.4 Administration Fee: €7.50
This fee is only charged if You complete a Transaction when there is a Shortfall on the Available Funds.
17.5 Monthly Management Fee: € 3.00
This fee is charged as of the expiration of 36 months as of the Date of Activation and is a management fee for the costs of administration of Your account.
18. Compensation
The Wertheim Village Prepaid MasterCard® Shopping Card is an electronic money product and although it is a product regulated by the Financial Conduct Authority, it is not covered by the Financial Services Compensation Scheme. No other compensation scheme exists to cover losses claimed in connection with the Wertheim Village Prepaid MasterCard® Shopping Card. This means that in the unlikely event that the Issuer becomes insolvent Your Wertheim Village Prepaid MasterCard® Shopping Card may become valueless and unusable and as a result You may lose Your Available Funds.
19. Assignment
We may assign the benefit and burden of these terms and conditions to another company at any time, on giving You 2 month's prior notice of this. If We do this, Your rights will not be affected.
20. Governing Law & Jurisdiction
This Cardholder Agreement and all arbitration proceedings will be governed by the laws of Germany under explicit exclusion of the CISG and the German International Private Law.
21. Changes to this Cardholder Agreement
This Cardholder Agreement constitutes the entire agreement between Us and any Purchaser and Cardholder regarding use of the Wertheim Village Prepaid MasterCard® Shopping Card. We may delay or waive any of Our rights at any time without waiving any of Our rights at any future time. Except as otherwise required by

applicable law, We may change this Cardholder Agreement, and its related services, at any time. If We think that a change is material We will write to You at least 2 months before making the change, unless a more immediate change is required by law or other valid reason. Otherwise We will notify You of any other changes within 2 months of making the change. You should regularly check the Website to inform Yourself of any such changes. By continuing to use the Wertheim Village Prepaid MasterCard® Shopping Card after such changes have taken effect, You are signifying Your acceptance to be bound by such new/amended Terms & Conditions. If You do not wish to be bound by such new/amended Terms & Conditions, You should cease using Your Wertheim Village Prepaid MasterCard® Shopping Card immediately. The change will automatically take effect and You will be taken to have accepted the notified change unless You tell Us that You do not agree to the change. In that event, We will treat that notice as notification that You wish immediately to terminate this Cardholder Agreement. In such circumstances We will refund any Available Funds on the Wertheim Village Prepaid MasterCard® Shopping Card in accordance with section 13 above and You will not be charged a Refund Fee.
We may make immediate changes to the exchange rate used to convert foreign transactions into Euro.
If We decide to increase or impose any new fees, We will tell You by e-mail, text, or post, at least 2 months before any changes take effect.
22. Communication
If You have an enquiry relating to Your Wertheim Village Prepaid MasterCard® Shopping Card, You can use the Customer Support page on the Website. We will deal with Your enquiry promptly. If You do not wish to enquire in this way You can alternatively call Our customer service telephone line on 0800 5250275. The customer service telephone line is a free service.
23. Complaints
If You would like to make a complaint, please write to Us at Wertheim Village, Almosenberg, 97877 Wertheim, Germany, or email or phone Us using the details on the Customer Support page on the Website. We have procedures in place to ensure Your complaint is handled fairly and quickly. However, if You are not satisfied with the outcome of Your complaint, You can write to the Financial Ombudsman Service, South Quay Plaza, 183 Marsh Wall, London E14 9SR, United Kingdom Tel: +44 (0)845 080 1800, e-mail: enquiries@financial-ombudsman.org.uk.
24. Your Details
It is Your responsibility to keep a record of Your Wertheim Village Prepaid MasterCard® Shopping Card details; these will be required for all correspondence with Us. The details include: the name and address of the Wertheim Village Prepaid MasterCard® Shopping Card Purchaser, the Wertheim Village Prepaid MasterCard® Shopping Card Receipt and where applicable the physical Wertheim Village Prepaid MasterCard® Shopping Card. You must let Us know as soon as possible if You change name, address, phone number or e-mail address. If We contact You in relation to Your Wertheim Village Prepaid MasterCard® Shopping Card, for example, to notify You that We have cancelled Your Wertheim Village Prepaid MasterCard® Shopping Card, or to send You a refund by cheque, We will use the most recent contact details You have provided to Us. Any e-mail to You will be treated as being received as soon as it is sent by Us. We will not be liable to You if Your contact details have changed and You have not told Us.

Your Rights to Redemption of Funds and Refunding of Transactions on your Prepaid Wertheim Village MasterCard Shopping Card
Redeeming the funds on your Wertheim Village Prepaid MasterCard® Shopping Card
You have the right to redeem the funds on Your Wertheim Village Prepaid MasterCard® Shopping Card at any time in whole or in part. To do so, please either send Us an e-mail using the "contact us" facility on the Website, or contact Us by telephone (+49 (0)9342 9199 100), requesting redemption and indicating the amount to be redeemed. If You request redemption of all funds on Your Wertheim Village Prepaid MasterCard Card, please confirm in writing that you have destroyed Your Wertheim Village Prepaid MasterCard® Shopping Card by cutting it up. When We process Your redemption request, We may require you to provide us with documents such as identification so that We may process Your request in accordance with legal requirements. We may also charge a redemption fee if one of the following circumstances applies:
- You are requesting redemption before termination or expiry of this Cardholder Agreement;
- You cancel this Cardholder Agreement before any agreed termination or expiry date; or
- You request redemption more than one year after the date of termination or expiry of this Cardholder Agreement

We will not redeem the value of the funds on your Wertheim Village Prepaid MasterCard® Shopping Card to you if your request for redemption of the funds is more than six years after the date of termination or expiry of this Agreement.
